New H-1B Lottery Rule: Higher Wages, Better Odds

Rather than each registration receiving a single chance, registrations will be entered into the lottery multiple times based on the Department of Labor’s four-tier wage system.

Level IV positions receive four entries, Level III receive three, Level II receive two, and Level I receive one entry. Higher-wage and higher-skill roles therefore gain measurably better odds of selection, while all wage levels remain eligible.

2. More Transparency & Mandatory Wage Information

Employers must now provide accurate wage levels, Standard Occupational Classification (SOC) codes, and worksite locations at the registration stage. This information must remain consistent throughout petition adjudication, and USCIS may deny or revoke petitions when inconsistencies are identified.

The new weighted structure is designed to prioritize higher-skilled and higher-paid positions while still allowing entry-level jobs to participate.
