H1B Visa Knowledge: October is Special

H-1B Visa Knowledge: October 2010, not January 2011, is the first month of FY2011 

October 1st, 2010 is the beginning of fiscal year 2011 in United States. It is also the first date 2011 cap subject H-1B visa could be used. 

H-1B visa sponsors(employers) may begin applying for the H-1B visa six months before the actual start date of the visa. For example, the beginning of the fiscal year 2011 is October 1, 2010, employers can apply as soon as April 1, 2010 for the fiscal year 2011 H-1B visa cap, but the beneficiary(employee) cannot start working until October 1st, if the visa is subject to H-1B visa cap. 

This is the reason many employers are unwilling to hire foreign worker before October. Even if the H-1B visa is approved within weeks, the employer still have to wait for several months before the employee could start working. 

Now it is October, employers become more enthusiastic in hiring foreign workers. This could be proved by USCIS weekly update of fiscal year 2011 H-1B Cap Count. As of October 15, 2010, 58,500 cap eligible H-1B visa petitions have been received by USCIS, a 16,500 increase from August 17, 2011. On average, it is 2,000 every week.
