TN Visa, NAFTA Professional visa


Overview: The nonimmigrant NAFTA Professional (TN) visa allows citizens of Canada and Mexico to work in United States in a prearranged business activity for a U.S. or foreign employer as NAFTA professionals. Spouses and unmarried children under the age of 21 of NAFTA Professionals (TN visa holders) may receive a TD visa.

Family: Spouse and unmarried children who are under 21 years of age may receive a TD visa. Dependents do not have to be citizens of Mexico or Canada. TD visa holder may not work in the United States, but can engage in full or part time study.

Period of Stay: initial stay of up to three years, may request for extension.

Green Card intent: Dual intent not permitted. Applicant has to establish that he or she will return home at some point in the future.

Statistics: In fiscal year 2010, 4,100 applicants applied for TN visa. United States issued 3,392 TN visa, and refused 708(402 were waived or overcome). During the same period, 3,027 applicants applied for TD visa. United States issued 2,572 TD Visa, and refused 455(304 were waived or overcome).

Applicant Qualification:
  1. Applicant is a citizen of Canada or Mexico;
  2. Profession is on the NAFTA list;
  3. Applicant has the qualifications of the profession1.
  4. Position in United States requires a NAFTA professional;
  5. Applicant will work in a prearranged full-time or part-time job


Who are not qualified:
  1. Self employment is not permitted;
  2. Permanent residents of Mexico or Canada are not qualified for TN visa.
  3. Applicant does not have the qualifications of the profession.

Requirement
  1. Mexican citizens require a visa to request admission to the U.S.
  2. Canadian citizens usually do not need a visa as a NAFTA Professional.
  3. A Canadian citizen with a non-Canadian spouse and child would need a visa, so his or her spouse and child could apply for TD visa.

How to Apply for TN Visa
Applicants may apply at consular sections around the world for a NAFTA professional (TN) visa. An interview at the U.S. Embassy or Consulate is required for visa applicants from age 14 to 79, with few exceptions. The first step in the visa application process is to make an appointment for an interview. An ink-free digital fingerprint scan will be quickly taken during the visa application process, usually at the interview.

  3. A passport valid for travel to the U.S.
  4. Online Nonimmigrant Visa Electronic Application, Form DS-160.
